InnerPulse, LLC (“InnerPulse”), creator of FlexBeat Metronome mobile applications (“FlexBeat”), is committed to protecting your personal information and your right to privacy. This policy describes information that InnerPulse may collect, how it may be used and what rights you have in relation to it. If there are any terms in this policy that you do not agree with, please discontinue use of FlexBeat. This privacy policy applies to all information collected by FlexBeat.

1. Collection of Personal Data

The sole online mobile application market places (“Mobile Application Market Places”) of FlexBeat are the App Store for iOS devices and the Google Play Store for Android devices. InnerPulse collects no personal data beyond what is collected by its Mobile Application Market Places. Data that InnerPulse receives from its Mobile Application Market Places may be shared with third parties for the following purposes:

• Compliance with Laws. InnerPulse may disclose your information where legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena, including in response to public authorities to meet national security or law enforcement requirements.

• Vital Interests and Legal Rights. InnerPulse may disclose your information where it is necessary to investigate, prevent, or take action regarding potential violations of InnerPulse policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which InnerPulse is involved.

InnerPulse may process any anonymous data provided by its Mobile Application Market Places for the following purposes:

• To respond to user feedback

• To enforce InnerPulse’s End User License Agreements

• For other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of promotional campaigns, and evaluation for improvement of FlexBeat products and services

2. Mobile Application Usage of Device Features

FlexBeat requests permission to use the following features from your mobile device for specific purposes:

• FlexBeat requests access to Bluetooth capability for the purpose of wirelessly connecting your mobile device to an external speaker in order to amplify the metronome audio playback.

• FlexBeat requests access to storage on your mobile device for the purpose of saving metronome patterns that you have created and metronome patterns that you choose to import into your FlexBeat app from other FlexBeat users.

• FlexBeat interacts with your mobile device’s designated Email application when you choose to share a metronome pattern with or receive a metronome pattern from another FlexBeat user. FlexBeat does not request use of personal contact data stored on your mobile device.

3. Your Privacy Rights

In some regions, such as the European Economic Area, you have certain rights under applicable data protection laws. These may include the right to:

• Request access and obtain a copy of your personal information

• Request rectification or erasure

• Restrict the processing of your personal information

• Data portability

InnerPulse will consider and act upon any request in accordance with applicable data protection laws.

InnerPulse may update this privacy policy from time to time. The updated version will be indicated by the “Revised” date and the updated version will be effective as soon as it is accessible.
